Trio Prep 1-on-1 Private Tutoring PoIicies

All tutoring sessions should be scheduled at the start of the program, at times mutually agreeable for the tutoring student and the Trio Prep tutor.
Students are responsible for coordinating any schedule changes for tutoring sessions with their tutors directly.
Once tutoring sessions are scheduled, a student may only reschedule or cancel a session with at least 24 hours advanced notice prior to the session start time.
If a student does not attend a scheduled private tutoring session, or is more than 15 minutes late without communicating with the tutor, the session will be forfeited and the number of hours scheduled for that session will be deducted from the account without refund.
Trio Prep private tutoring can be purchased at a minimum of 10 hours for new tutoring students. The minimum purchase for adding more hours to an existing program is 2 hours.
Private tutoring sessions expire 365 days from the date of initial purchase. Unused private tutoring hours will not be refunded.
Private tutoring sessions may be recorded and viewed for quality assurance and training purposes. Recordings can only be shared with Trio Prep staff, students who appear in the recording, or the parents of these students. If you wish to opt out of session recording, please email us at trio@trioprep.com.

Trio Prep Course schedules are set in advance and agreed to by the student at the time of enrollment. Any course session that a student is not able to attend will not be rescheduled, refunded, or credited to the account.

Payments

Payment must be received at least 24 hours prior to any scheduled private tutoring session or Trio Prep Course enrollment.
Otherwise, Trio Prep makes no guarantee of tutor availability or course enrollment space.
Tutors are not permitted to conduct any session until payment for the session has been received.

Refunds

Students or parents can unenroll from any private tutoring package or Trio Prep Course with at least 24 hours advanced notice prior to the start time of the first scheduled class or tutoring session.
Once requested, a refund for the purchase price, minus a 10% unenrollment fee, will be issued. Refunds typically take 7 business days to process.
Trio Prep does not offer refunds for our services once they have commenced.

Scholarship Codes

Scholarship codes issued by Trio Prep are valid for private tutoring credits that can be redeemed for 1 hour of private tutoring for every $100 stated in the scholarship offer.
Scholarship codes can only be applied to enrollments in Trio Prep Courses, Solo Study Programs, or 1-on-1 Private Tutoring packages of 10 hours or more.
When a scholarship code is applied at time of enrollment, the additional hours will not immediately appear on the enrollment details page. The scholarship will reviewed by the Trio Prep team prior to approval. Once approved, the student and parent will receive an email within 72 hours confirming the number of tutoring hours that have been added to the account.
Scholarship codes are only valid for private tutoring credits that are added to a Trio Prep enrollment. Scholarship codes are not valid for discounts on the purchase price of an enrollment.
Scholarship codes cannot be used in combination with other discounts, coupons, promotions, or other scholarship codes. Only one scholarship code may be redeemed per student.

Scholarship codes must be entered at time of online enrollment in order to be applied. Scholarship codes cannot be applied after enrollment is submitted.

Scholarship codes are strictly free private tutoring credits that have no cash value and may not be redeemed for cash.
All scholarship codes expire 30 days from the date of issue. Trio Prep reserves the right to honor scholarship codes beyond the expiration date on a case-by-case basis.

Online Code of Conduct

As part of Trio Prep's commitment to creating a positive and productive learning environment for all of our students, we expect students to abide by an online code of conduct that is respectful of those around them. Violations of our online code of conduct include, but are not limited to

disruptions to the learning environment (i.e. use of profanity, harassment, discrimination, bullying, etc.)
violence or threats of violence toward students or Trio Prep staff
improper use of online platform, webcam, or microphone

If a student is found to be in violation of Trio Prep's online code of conduct, the student will be subject to termination of Trio Prep enrollment and forfeiture of enrollment costs without refund for unused hours.

Trio Prep iPad Offer

The following policies are for parents and students who have received a free Trio Prep iPad as part of their SAT or ACT tutoring program enrollment.

To receive a free Trio Prep iPad, a student or parent must complete the online enrollment process for a Trio Prep SAT or ACT tutoring program and pay the corresponding enrollment fee for 15 sessions of 1-on-1 tutoring at trioprep.com/ipad. This offer is limited to one (1) enrollment per customer and is only available until december 25, 2019 or while supplies last.
All Trio Prep iPads provided as part of the offer are 7th Generation Latest Edition, Brand New, Space Gray, 10.2-inch, 32GB, Wi-Fi only models, and will arrive in original Apple factory packaging. All models are new and not refurbished. Full feature descriptions for this iPad can be found at apple.com/ipad-10.2.
Trio Prep iPads will be shipped to the address provided at the time of enrollment. Free standard shipping for iPads is included to all addresses within the U.S. and to all major cities outside of the U.S. If the cost of shipping to any international address is greater than $50 USD, Trio Prep will contact the parent to discuss additional costs prior to finalizing enrollment. This offer is subject to all applicable laws and is void where prohibited. Trio Prep iPad recipients assume all liability for any injuries or damage caused or claimed to be caused by participation in this promotion or by the use or misuse of the iPad. Recipients will not hold Trio Prep responsible for any physical or hardware damage to iPad. Trio Prep will not be responsible for replacing any lost, stolen, or damaged iPads.
Students and parents expressly acknowledge and agree that, to the extent permitted by applicable law, use of the Trio Prep iPad and its iOS software and any applications or services performed by or accessed through the iOS software is at the sole risk of the user. To the extent an individual chooses to use or access third party services or applications, the individual does so at his or her own risk and is responsible for compliance with any applicable laws. Any user of the device agrees that Trio Prep is not liable for any violation of privacy or data laws made to or from the device.

Trio Prep Course Policies

If a Trio Prep Course does not register the minimum number of students needed to run, parents and students will be notified at least 72 hours before the first class. We reserve the right to reschedule or cancel any Trio Prep Course due to factors outside of our control. If a course is cancelled for any reason by Trio Prep, the student will receive a free enrollment in any other Trio Prep course or a credit for private tutoring hours equivalent to the purchase price of the course.
Trio Prep Course classes may be recorded and viewed for quality assurance and training purposes. Recordings can only be shared with Trio Prep staff, students who appear in the recording, or the parents of these students. Terms & Conditions

Content and Materials Agreement

Trio Prep Materials are for Trio Prep students only: All Trio Prep content, including but not limited to digital materials, flipdecks, recordings, materials available from trioprep.com, and all electronic documents that you will receive or to which you will have access during your Trio Prep enrollment (collectively, "Materials"), is for your personal use only and may not be shared, sold, transmitted, or transferred to another person in any manner.

Students are strictly prohibited from downloading, recording, duplicating or reproducing any Materials in any medium for any reason. If a student is found to be in violation, the student will be subject to immediate removal and termination of Trio Prep enrollment and forfeiture of enrollment costs without refund for unused hours.

Non-solicitation Agreement

By becoming a Trio Prep client, you agree that you will not solicit for employment or hire any person employed by Trio Prep at any time during the term of Trio Prep’s services to you. Any inquiries regarding the additional services of a Trio Prep employee should be directed to trio@trioprep.com.

Privacy policy

As outlined below, Trio Prep will not share any personal information you have given us without your permission to do so. We may use your contact information to notify you of special offers and promotions. If you do not wish to receive promotional offers, we will honor any email unsubscribe requests.

Information We Collect

We collect personally identifiable information from you when you purchase our services. Trio Prep only requests information that we need in order for you to participate in the service (for example, a student's name and email address) or pay for the service (credit card details). Your information will be saved as needed using standard, PCI compliant security methods. We do not share your credit card information with any third parties except to the extent needed to process your transaction. We may track data from our customers in aggregate form. Such aggregated data does not uniquely identify you.

Use of Personal Data

We may use your Personal Data in the following ways:

To fulfill your requests for services, such as enrolling you in a course or responding to a specific inquiry;
To customize the learning experience for a student;
To administer, support, and develop our business;
To send you information about Trio Prep services; and
To share pertinent information with appropriate high school staff.

Communication with Schools

We work with schools and institutions to provide our test preparation programs. Trio Prep may share personally identifiable information that you provide to us with appropriate high school staff, such as counselors and administration. Anyone with access to such records has agreed to maintain strict confidentiality. In addition, your school may require us to share your information with others legally entitled to access your academic records, such as your state department of education. If statistics are released to non-authorized individuals, we will remove all identifying information.

Sharing of Information

We at Trio Prep will always do everything in our power to respect and protect the privacy of individual user data for school administrators, teachers, parents, and students. We will never disclose personal information that identifies any of our students without authorization to do so from a parent, legal guardian, or student over the age of 18. Only the student, the parent, and authorized school staff have access to this information outside of our organization. Trio Prep retains the right to release aggregate performance information provided this aggregate data contains no personally identifiable information of individual students.

Consent and Release

By enrolling in any Trio Prep Course or private tutoring program, you agree that any online interactions between students and trio prep staff may be recorded and viewed for quality assurance and training purposes. Trio Prep is only permitted to share such recordings outside of the organization with students who appear in the recording or the parents of these students.

Comments and Reviews

By submitting any written content such as comments, reviews, or feedback to Trio Prep through the website or via email with any staff member, you grant Trio Prep a nonexclusive, royalty-free right to use, reproduce, adapt, distribute, and display such written content for marketing purposes, both online and in print. You grant Trio Prep the right to use your first name and last initial in connection with such content, as well as the first name and last initial of your student and the student's high school. Recordings, videos, and photographs of students will never be used for marketing purposes without specific written authorization to do so from a parent, legal guardian, or student over the age of 18.

Legal Compliance

Though we make every effort to preserve your privacy, we may be required by law to disclose personal information if we have a good-faith belief that such action is necessary to comply with a judicial proceeding, a court order, or a request from law enforcement.

Facilities Use

It is expressly agreed that students will be joining online sessions from facilities not controlled by Trio Prep, such as homes, libraries, schools, and public places. You waive any claim against Trio Prep arising from your student's use of any such facilities, including claims related to the safety and security of these facilities.

Arbitration & Class/Collective Action Waiver

Any and all disputes arising from or related to this Agreement, other than disputes relating to intellectual property infringement, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by arbitration administered by a single arbitrator under the then-applicable rules of the American Arbitration Association in accordance the Federal Arbitration Act in a mutually agreeable location within 10 miles of the Trio Prep LLC home office location. Judgment on the arbitral award may be entered in any court having jurisdiction thereof.

To the maximum extent permitted by law, should you wish to initiate a legal action against Trio Prep, you waive any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Trio Prep or a related entity is a party. The same applies to Trio Prep's legal actions against you. Thus, you and Trio Prep agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class. Further, unless both you and Trio Prep agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over a representative or class proceeding.

Changes to Our Policies, Terms and Conditions

We reserve the right to update or remove these Policies, Terms and Conditions, at our discretion. We will post any policy changes here and encourage you to visit this webpage regularly to make sure you have the most up to date information.

Agreement of Terms

This Agreement supersedes all prior oral or written agreements, if any, between the parties and constitutes the entire agreement between the parties. The agreement cannot be changed or modified orally. Any change or modification must be in writing and agreed to by both parties. If any provision of this Agreement is found to be unenforceable for any reason, such provision shall be construed by limiting it to make it enforceable to the maximum extent permitted by law, and the remainder of this Agreement shall continue in full force and effect.
